Broker of Record Procedure

ProBenefits has traditionally marketed its services through brokers and plan advisors. As a result, it is our full intent to honor the broker relationship and serve the employer and the broker as well as possible. Occasionally, potential conflicts will arise with two or more brokers regarding the same employer client. This policy is intended to reflect the procedure we will attempt to follow in those situations.

Proposed Cases

In the event two or more brokers deliver the same prospect, ProBenefits will immediately notify both parties that:

  1. The same prospect has been represented by another broker, and
  2. ProBenefits must honor both requests until receiving a Broker of Record letter signed by the prospect, indicating which broker has been selected to represent them.

Committed Cases

A "Committed Case" is a client who has given us the go-ahead to install a plan, but the case is not yet in force. If ProBenefits is not clear about who is the Broker of Record for a Committed Case, ProBenefits will:

  1. Contact the client and simply ask for written confirmation (email, fax, or letter) of who is to serve as Broker of Record.
  2. Provide the resulting written confirmation to each party in contention, then proceed to work with the designated Broker of Record.

In-Force Cases

If an in-force case issues a Broker of Record letter assigning a new servicing broker, ProBenefits will honor the client's request as of the specified effective date. These requests will always be honored and we will work with any broker that the client requests. However, it is within our discretion whether to recognize a new broker for compensation purposes, and we reserve the right to provide commissions only to brokers who were responsible for a plan being originally set up with us
